1. ELIGIBILITY
This giveaway is open to legal residents of the United States, 18 years of age or older at the time of entry. Employees, officers, and directors of Spear Travel Group ("Sponsor"), its affiliates, subsidiaries, advertising and promotion agencies, and members of their immediate families or households are not eligible to participate. Void where prohibited by law.
2. PRIZE PACKAGE
One (1) Grand Prize winner will receive: 3-night stay for 2 adults or 2 adults & 2 children (under 12) at Dreams Flora Resort & Spa [including accommodations and specified inclusions]. (Families with 1 child under 12 or more than 3 children are eligible to enter; a cost adjustment may apply. Additional nights beyond the 3-night prize may be added at the winner's expense.) The Approximate Retail Value (ARV) of this prize is up to $3,500. Actual value may vary based on travel dates and guest ages at the time of booking. All prize details are at Sponsor's sole discretion.
3. NON-TRANSFERABLE / NO CASH ALTERNATIVE
The prize is non-transferable and must be accepted as awarded. No cash equivalent, substitution, or alternative prize will be offered by the Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value in the event the advertised prize becomes unavailable.
4. BLACKOUT DATES & RESERVATION REQUIREMENTS
The prize is subject to availability and blackout dates, including but not limited to holidays and special event periods. Travel and accommodations must be booked in advance, subject to availability at the time of redemption. Winner must redeem the prize by April 30, 2028.
5. TRAVEL COSTS
Airfare, ground transportation, parking, baggage fees, gratuities, and all other incidental travel expenses are the sole responsibility of the winner and guest(s). The Sponsor is not responsible for any additional costs incurred in connection with acceptance or use of the prize.
6. TAXES & FEES
All federal, state, and local taxes, fees, and surcharges on the prize are the sole responsibility of the winner. Winner may be required to complete and return an IRS Form W-9 (or equivalent) prior to receiving the prize. A 1099 tax form will be issued if required by law.
7. LIABILITY RELEASE
By participating, entrants agree to release, discharge, and hold harmless Dreams Flora Resort & Spa, Spear Travel Group, and their respective parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and representatives from any and all liability, claims, damages, injuries, losses, or costs arising out of or related to participation in this giveaway or acceptance, use, or misuse of the prize, including any travel or activities undertaken in connection therewith.
8. CONDUCT & DISQUALIFICATION
Sponsor reserves the right, in its sole discretion, to disqualify any winner who engages in inappropriate, unsportsmanlike, or unlawful conduct, or any behavior deemed harmful to the Sponsor's reputation or brand, at any point before or during prize redemption. Disqualification forfeits all rights to the prize.
9. MODIFICATION & CANCELLATION
Sponsor reserves the right to cancel, suspend, modify, or terminate this giveaway at any time without prior notice if, in Sponsor's sole judgment, fraud, technical failures, or any other factor impairs the integrity or proper functioning of the promotion. In such event, Sponsor reserves the right to award the prize in a manner deemed fair and equitable.
10. PRIVACY
Personal information collected in connection with this giveaway is subject to Sponsor's Privacy Policy, available at https://www.speartravelgroup.com/privacy-policy. By entering, participants consent to the collection, use, and disclosure of their information as described therein. Winner's name and likeness may be used by Sponsor for promotional purposes without additional compensation, where permitted by law.
11. DISPUTES
All disputes arising out of or relating to this giveaway shall be governed by the laws of the State of New Jersey, without regard to conflict of law principles. By entering, participants agree that any disputes shall be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association, and participants waive any right to participate in a class action lawsuit or class-wide arbitration.
12. SOCIAL MEDIA DISCLOSURE
This promotion is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc. (Instagram/Facebook), or any other social media platform through which it may be promoted. By participating, you acknowledge that you are providing your information to Spear Travel Group and not to any social media platform. Sponsor's decisions are final and binding in all matters related to this giveaway. Sponsor is not responsible for lost, late, incomplete, misdirected, or illegible entries. This giveaway is subject to all applicable federal, state, and local laws.
